Thus, it proposes that if it is not possible to amend the Constitution on this point, it is decided to rationalize the presidential vacancy in order to respect the right to due process of the president, and limit the discretion of the Congress.El presente artículo trata sobre la figura de la vacancia presidencial por la causal de incapacidad moral permanente. Así, sostiene que en los hechos ésta opera como una suerte de juicio político informal a causa de las limitaciones, que posee el artículo 117 de la Constitución, que impide acusar al presidente durante su mandato fuera de cuatro supuestos extraordinarios.
