El presente artículo tiene por objeto realizar una vasta descripción y análisis en torno a los precedentes vinculantes emitidos por el Tribunal Constitucional, los cuales son regulados en el artículo VII del Título Preliminar del Código Procesal Constitucional. A lo largo del texto, el autor realiza un análisis histórico, el cual explica la existencia y el desarrollo de esta institución, así como detalla los supuestos en los cuales puede sentarse un precedente en nuestro ordenamiento jurídico. Asimismo, critica la forma en cómo se viene regulando esta institución por el propio Tribunal Constitucional y ofrece, en la última parte del texto, algunas posibles soluciones para alcanzar el equilibrio entre la seguridad jurídica y la justicia social. Así, el lector podrá apreciar los problemas que se presentan en la regulación de esta institución así como la perspectiva del autor respecto a las soluciones posibles. The goal of this article is to present a comprehensive description and analysis of binding precedents in decisions issued by the Constitutional Tribunal, which are regulated in Article VII of the Preliminary Title of the Constitutional Procedural Code. Throughout the text, the author provides a historical analysis which explains the existence and development of this code and explains the situations in which a precedent can be established in our justice system. At the same time, the author criticizes the way this code is being regulated by the Constitutional Tribunal and offers some possible solutions to reach an equilibrium between legal security and social justice. This analysis provides the reader with an appreciation of the problems that occur in the regulation of this code and the author’s proposals for possible solutions.
