The main conclusion is that, although prescription affects the enforceability of the pretension, the right of action itself is not extinguished and remains accessible in future judicial proceedings.El artículo estudia los alcances de la prescripción regulada en el artículo 1989 del Código Civil peruano, el cual establece que “La prescripción extingue la acción, pero no el derecho mismo”. A través de un análisis detallado, los autores exploran las diferencias entre acción y pretensión, así como la relevancia del transcurso del tiempo en la prescripción. De ese modo, examinan el concepto de derecho subsistente, pero no exigible y su tratamiento en el sistema jurídico peruano.
