Justice systems face the challenge of deciding whether to treat young people as adults or juveniles, highlighting the importance of understanding the factors that affect their ability to make decisions and assess the consequences of their actions. The review indicates that the cognitive and psychosocial skills necessary for mature decision-making continue to develop during late adolescence, supporting the need for differentiated approaches in the criminal treatment of young offenders. This analysis was based on a systematic review of literature published between 2012 and 2023, selecting peer-reviewed articles from databases such as PsycINFO, PubMed, and Google Scholar. The findings show that young people with psychosocial immaturity have difficulty foreseeing the long-term consequences of their actions. It is concluded that decision-making and self-regulation continue to develop until late adolescence, justifying a differentiated penal approach.Este artículo realiza una revisión crítica de la literatura reciente sobre cómo la inmadurez psicosocial y el desarrollo cognitivo influyen en la responsabilidad penal de los jóvenes infractores. Los sistemas judiciales enfrentan el desafío de decidir si tratar a los jóvenes como adultos o menores, lo que resalta la importancia de comprender los factores que afectan su capacidad para tomar decisiones y evaluar las consecuencias de sus acciones. La revisión indica que las habilidades cognitivas y psicosociales necesarias para decisiones maduras siguen desarrollándose durante la adolescencia tardía, lo que respalda enfoques diferenciados en el tratamiento penal juvenil. Con base en una revisión sistemática de literatura publicada entre 2012 y 2023 en bases como PsycINFO, PubMed y Google Scholar, se evaluaron estudios sobre la relación entre madurez psicosocial, toma de decisiones y conducta delictiva adolescente. Los hallazgos muestran que los jóvenes con inmadurez psicosocial tienen dificultades para prever consecuencias a largo plazo.
