Maintains until now, with serious detriment to the axiological foundation of the democratic state and law, without anyone doing anything about it. This criminal institution is not only marked by overcrowding and tugurization, derived from a denigrating penitentiary system and an illegitimate criminal system, but reproduces social discrimination within a highly corrupt environment. It proposes some concrete alternatives of criminological policy for the state to fulfill its obligation to respect, promote and defend the human rights of internal persons in penal establishments.La cárcel como pena está destinada únicamente a la suspensión del ejercicio del derecho a la libertad personal ambulatoria, sin embargo, de antiguo ha significado, en la práctica, la negación de ciertos derechos civiles, políticos, económicos, sociales y culturales, situación que se mantiene hasta la actualidad, con grave detrimento del fundamento axiológico del estado democrático y de derecho, sin que nadie haga algo al respecto. Esta institución penal no solamente se encuentra marcada por el hacinamiento y la tugurización, derivada de un sistema penitenciario denigrante y un sistema penal ilegítimo, sino que reproduce la discriminación social en el marco de un entorno altamente corrupto.
