Then, it is exposed that the penal system, and not only its prison environment, has been wasting, for many years, the possibility that the custodial sentence fulfills its resocializing purpose. Subsequently, it explains what privatizing prison administration implies and what are the advantages and disadvantages of doing so. The Peruvian experience of productive prisons promoted since 2017 is described below. Finally, the main conclusions that have been reached as a result of the investigation are provided.El presente artículo de revisión se dedica, en la introducción, a describir la problemática identificada por el autor respecto al sistema penitenciario, como también a determinar los objetivos de este. Luego, se expone que el sistema penal, y no solamente su ámbito penitenciario, ha venido desperdiciando, durante muchos años, la posibilidad de que la pena privativa de libertad cumpla su finalidad resocializadora. Posteriormente, se explica qué implica privatizar la administración de las cárceles y cuáles son las ventajas y desventajas de hacerlo. A continuación, se describe la experiencia peruana de cárceles productivas impulsada desde el año 2017.
