In particular, this article will explore the doctrine of ‘fiduciary obligations’ in the context of the State’s relationship with indigenous peoples - focusing on the protection of the ownership of indigenous lands and the legal and administrative processes of the State – to evaluate whether the context, order and basis of the State’s fiduciary position can provide solutions in a Peruvian context.Los conflictos sociales y ambientales derivados de actividades extractivas son un tema ampliamente desarrollado en diversas disciplinas. Este artículo no intenta evaluar una visión completa del problema, sino propone una revisión del mismo bajo una óptica jurídica diferente, sirviéndonos de la comparación jurídica y de la argumentación de la teoría legal. Así, nuestro trabajo explorará la doctrina de las ‘obligaciones fiduciarias’ del Estado respecto a los pueblos indígenas, centrándose en la protección de la propiedad de las tierras indígenas y su relación con las medidas legales y administrativas del Estado.
