One of the problems faced is that there is an ambiguity between the boundary of the private and the public, and this is be: cause many of the functions that promote social rights are services that can be found in the private sector, such as education and security. This causes a devaluation of these services from the state and in some cases a negligent attitude on the part of the administrative process. However, there are dis tinctions in the classification of negative and positive rights, one require the state to refrain from intervening or act in a certain way, another imposed to perform certain behaviors. The first group comprises the traditional civil and political rights, social rights second.La necesidad de los derechos sociales en países emergentes es fundamental para el pleno desarrollo de la población en diferentes aspectos tanto económico, cultural, tecnológico, ambiental, social...etc. Según el artículo 1 de la constitución política del Perú la persona y su “dignidad” son el fin supremo de la sociedad y del Estado, y es en el caso de los derechos sociales donde se garantiza la dignidad de las personas menos favorecidas o victimas hechos fortuitos a través de políticas públicas. Una de los problemas que afronta es que existe una ambigüedad entre el límite de los privado y lo público, y esto se debe a que muchas de las funciones que los derechos sociales promueven son servicios que se pueden encontrar en la actividad priva da, como la educación y la seguridad. Esto causa una desvaloración a estos servicios de parte del estado y en algunos casos una actitud omisiva de parte de la vía administrativa. Sin embargo, existen distinciones en la clasificación de derechos negativos y positivos, unos exigen que el estado se abstenga de intervenir o actuar de determinada manera, otro imponen la realización de determinadas conductas.
