The third paragraph of the article six of the Brazilian Civil Code of 1916, which declared that Amazonian persons had relative legal incapacity, led to a debate in Peru that lasted for years. Those who championed the inclusion of a similar approach in the Peruvian Civil Code sought to protect the natives, who, in their view, were in disadvantage in modern society because of their lack of education. In the final version of the code, it was decided not to include that rule and to maintain the criteria of formal and artificial equality regarding the legal capacity of the natives, mainly because otherwise was even more harmful for them. However, a protectionist sentiment remained in the political and cultural discourse.Un importante y dilatado debate tuvo lugar en el Perú al discutirse, en la década del veinte, cuando se elaboraba el Código Civil de 1936, en torno a la capacidad jurídica de los indígenas. El artículo 6, párrafo tercero del Código Civil brasileño de 1916, que declaró incapaces relativos a los selváticos, propició un debate en el Perú que duró años. Quienes impulsaban la inclusión de un criterio similar en el código civil peruano buscaban proteger a los indígenas, quienes, según su visión, se encontraban en desventaja en la sociedad moderna por su falta de educación. En la versión definitiva se decidió no incluir dicha norma y se mantuvo un criterio de igualdad formal y artificial respecto de la capacidad de los nativos, principalmente porque se consideró que lo contrario sería aún más perjudicial para ellos.
