Therefore, this fact has In the first place, it is necessary to question whether the moral autonomy of man, from an individualistic perspective, continues to be the ultimate foundation of human rights in the Constitutional State, and this, since there are other realities such as the community, the nation, among others, which also have moral relevance and which in some situations could condition the exercise of individual autonomy. The individual or the community cannot be understood in isolation and, much less, be considered independently as the only moral entities relevant to the Law; because individual and community complement each other permanently and are projected on each other. Hence, there is a need to "develop legal instruments that enable the development of minority groups, so that their diversities do not make their members inferior to those who belong to the majority groups."Hoy en día el fenómeno del multiculturalismo no es extraño a ninguna realidad, a tal punto que las democracias occidentales han tenido que hacer una pausa en su 2ter diario y prestar atención a una agenda pendiente que propone la diversidad etnocultural, Por tanto, este hecho ha propiciado que, en primer lugar, haya que cuestionarse sobre si la autonomía moral del hombre, desde una perspectiva individualista, sigue siendo el fundamento último de los derechos humanos en el Estado Constitucional, y, ello, por cuanto, existen otras realidades como son la comunidad, la nación, entre otras, que también ostentan relevancia moral y que en algunas situaciones podrían condicionar el ejercicio de la autonomía individual. El individuo o la comunidad no pueden ser entendidos de manera aislada y, mucho menos, ser considerados de manera independiente como las únicas entidades morales relevantes para el Derecho; debido a que individuo y comunidad se complementan permanentemente y se proyectan uno en el otro.
