En el presente trabajo nos dedicaremos a despejar las controversias que rodean a dicho precepto, es decir, a desentrañar cuál es la fundamentación filosófico-política material que subyace a la Ley Fundamental de 1993, así como a precisar cuál es el concepto de derechos fundamentales que nuestra Constitución adopta. Una vez resuelta dicha problemática nos orientaremos a delinear los alcances del multiculturalismo liberal para justificar por qué resulta ser la propuesta ius filosófica constitucionalmente idónea para interpretar el artículo149 de la Constitución.

El artículo aborda el clásico discurso naturalista que promueve la inferioridad de las mujeres y sustenta las desigualdades de género, así como la tarea emprendida por el movimiento feminista para erradicar la opresión sexista. A partir de ello, expone la crítica que el feminismo formula a las distintas líneas de pensamiento, en particular a la liberal, con el objeto de promover la participación de la mujer en el ámbito público.
