Rationalism rationalist criteria that welcomes, supports as the belief in the equal capacity of human beings to make use of the legal right and distinguish right from wrong. Because legal reasoning on the belief that the (conventional) legal system is founded on the freedom of all human individuals to discuss, agree, agree and decide to act on the findings of the legal reason, in the process of creating the legal normative order. Political, because it assumes as true, which is a condition of legal action the responsibility that all people from the effects of their actions. The belief in equality (in the rational capacity) and freedom (of will) of the people is the basis for the attribution of responsibility (correlative to action) by the results of what was decided and done, being then necessary consequence rational legal legal action.Para fundamentar la presente exposición acogemos un conjunto de criterios o creencias que pertenecen a una doctrina muy antigua, practicada en todos los tiempos y lugares, a los que cabría denominar racionalismo jurídico y político. Racionalismo porque acoge criterios racionalistas, en cuanto sustenta la creencia en la igual capacidad de los seres humanos para hacer uso de la razón jurídica y distinguir lo justo de lo injusto. Jurídico porque razona sobre la creencia en que el orden jurídico (convencional) encuentra su fundamento en la libertad de todos los individuos humanos para deliberar, concordar, acordar y decidirse a actuar conforme a las determinaciones de la razón jurídica, en el proceso de creación del orden normativo jurídico. Político, porque asume como cierto, que es condición de la acción jurídica la responsabilidad que cabe a todas las personas por los efectos de sus actos.
