It is based on the recognition of Mexico as a multiethnic and multicultural society and on the importance of the human rights of its native peoples, as recognized through the reform of articles 1 and 2 of the Constitution of 2001 and 2011. This paper proposes regulatory legislation as an indispensable means of preserving the cultural heritage of Mexico and intercultural dialogue.Esta investigación surge de la preocupación por integrar los derechos indígenas en México para permitir la coexistencia pacífica de las instituciones del derecho positivo mexicano y los sistemas jurídicos de los 62 pueblos indígenas que viven en el país. Se basa en el reconocimiento de México como sociedad multiétnica y multicultural y en la importancia de los derechos humanos establecidos en favor de sus pueblos originarios gracias a las reformas de los art. 1° y 2° de la Constitución de los años 2001 y 2011, respectivamente.
