However, the present research work manages to demonstrate that in the casuistry the criminal judges grant undue legitimacy to the civil actor to claim a criminal claim that it is not their responsibility to defend, even arrogating ownership of the criminal action of the Public Ministry. It is possible to prove that the civil actor has subordinated his claim for compensation to the prior conviction of a crime, contrary to what is stipulated in the Criminal Procedure Code of 2004. It is also shown that criminal judges agree to various requirements of the civil actor regarding the conduct punitive of the investigated many times in contrast to the decision made by the Public Ministry. It is concluded that the de facto legitimacy improperly granted to the civil actor ends up subjecting the investigated to a double criminal prosecution, one from the Public Ministry, and another, exclusive to the civil actor.Nuestro sistema procesal penal confiere la posibilidad de requerir al órgano jurisdiccional dos pretensiones cuando se ha cometido un hecho delictivo. La primera de estas es la pretensión penal, cuyo titular es el Ministerio Público; la segunda pretensión es la civil resarcitoria, la cual es reclamada por el agraviado constituido en actor civil. Sin embargo, el presente trabajo de investigación logra demostrar que en la casuística los jueces penales otorgan legitimidad indebida al actor civil para reclamar una pretensión penal que no le corresponde defender, llegando a arrogarse la titularidad de la acción penal del Ministerio Público. Se logra   acreditar que el actor civil ha supeditado su pretensión resarcitoria a la previa condena de un delito, contrario a lo que estipula el Código Procesal Penal del 2004. Se demuestra también que, los jueces penales acceden a diversos requerimientos del actor civil sobre la conducta punitiva del investigado muchas veces en contraposición a la decisión que toma el Ministerio Público.
