It is necessary to review compliance with the right to water in peasant and indigenous communities, which has historically been restricted, causing situations of water injustice in the communities that live in the territories where the water is born. Ecuador's legal system grants rights to nature and water, but it must also ensure the right of the population to enjoy water as a fundamental right, in a context of respect and appreciation of worldviews for their care. This article begins with a historical perspective in which changes and loss of rights are observed in the neoliberal phase, to give way to the formal recovery of those rights linked with a legal pluralism, which today leaves new challenges for the whole social and nationalities and indigenous peoples in particular.La gestión del agua en el Ecuador cuenta con una importante experiencia desde tiempos prehistóricos hasta tiempos actuales, donde destacan escenarios como el reconocimiento de estrategias ancestrales de conservación, pugnas por el acceso y control desde sectores de poder, abordajes legales que en la nueva Constitución le confiere derecho y orden de prelación al agua. A su vez, es necesaria la revisión del cumplimiento del derecho al agua en las comunidades campesinas e indígenas, que históricamente ha sido restringido, provocando situaciones de injusticia hídrica en las comunidades que viven en los territorios donde nace el agua. El ordenamiento jurídico del Ecuador concede derechos a la naturaleza y al agua, pero también debe velar por el derecho de la población al disfrute del agua como un derecho fundamental, en contexto de respeto y valoración de las cosmovisiones para su cuidado.
