Sumario:The crime of aggression, successor to the crime against peace of the Statute of the Tribunal Nuremberg International, constitutes the most serious of international crimes. The committing the crime of aggression represents an ipso facto threat against peace international. The Nuremberg Tribunal qualified the war as aggression in its sentence: “Starting a war of aggression, therefore, is not only an international crime; is he supreme international crime that differs from other war crimes only in that contains in itself the accumulated evil of the whole.” The crime of aggression is thus a serious violation of the UN Charter and its fundamental principles. Taking the case of the Russian invasion against Ukraine we will examine how the crime of aggression in accordance with the most up-to-date and recent expression of the Law International Criminal Law which is the Rome Statute of the International Criminal Court.
