However, in the Civil Code such treatment is omitted and there is a tendency to equate it to an onerous act or a payment, which is not uncommon to find also in several sectors of the national and foreign doctrine.The author criticizes these positions, pointing out several deficiencies, and argues that the remunerative donation is a subtype of donation that is entered into freely. Furthermore, he argues that the remunerative donation should not be equated with mercantile interests, given its essence and the values it promotes. Likewise, in view of the legal gap in the Civil Code, the author identifies and specifies the scope that this contract should have.La donación remuneratoria tiene un tratamiento parcialmente diferente al de una donación ordinaria; no se le aplican las normas de la revocación ni las de la obligación de alimentos (entre ellas las normas que protegen la legítima). Sin embargo, en el Código Civil se omite tal tratamiento y existe una tendencia a equipararla a un acto oneroso o a un pago, lo cual no es raro encontrar también en varios sectores de la doctrina nacional y extranjera.El autor critica estas posturas, señalando varias deficiencias, y sostiene que la donación remuneratoria es un subtipo de donación que se celebra de manera libre. Además, argumenta que la donación remuneratoria no debe ser equiparada con los intereses mercantiles, dada su esencia y los valores que promueve.
