This is a serious matter as it reflects a crisis triggered by the employers’ group’s questioning about including the right to strike in the ILO Convention No. 87 and the capacity of the Committee of Experts on the Application of Conventions and Recommendations to interpret the respective standards. This issue may offer an opportunity to assess the complementarity of labour human rights protection systems and the suitability of the advisory opinion to be issued to contribute to restoring the functioning of ILO methods after this major incident.La disputa producida al interior de la Organización Internacional del Trabajo respecto al ejercicio del derecho de huelga ha motivado que el Consejo de Administración decida someter el asunto ante la Corte Internacional de Justicia, invocando su competencia consultiva. Se trata de un asunto grave pues expresa una crisis provocada por el cuestionamiento del grupo empleador a la presencia del derecho de huelga dentro del Convenio núm. 87 de la OIT y a la capacidad del Comité de Expertos en la Aplicación de Convenios y Recomendaciones de interpretar las normas respectivas.
