Dada la creciente crisis económica en esta nueva era de la globalización, el autor realiza algunas reflexiones del impacto que ella tiene en las relaciones laborales en general. Los autores presentan un análisis lógico-jurídico sobre los principales argumentos contenidos en los discursos que se han dado en nuestro país a favor de la reforma del régimen de estabilidad laboral en sentido reductor. Así, comprendiendo al periodo que corre desde la publicación de las conocidas sentencias del Tribunal Constitucional sobre reposición laboral hasta el actual debate suscitado tras la aprobación unilateral de la Política Nacional de Productividad y Competitividad, en el texto se identifican agrupados los argumentos implícitos y explícitos que emprenden quienes proponen una revisión del régimen de protección contra el despido. Todo esto con el objeto de analizar el fundamento constitucional de tal argumentación, desde la tensión entre los principios de libertad de empresa y de estabilidad laboral.

The relationship between the trade union movement and labour inspection is complex and its observation in the Peruvian context in recent years allows us to deduce certain practical rules about this reality. We are not facing a simple sum of protective efforts over the rights of workers covered by both entities: there are cases in which the real capacity of both actors can be mutually enhanced and sometimes counteracted. Thus, after a legal investigation –which makes use of inductive and jurisprudential methods– and with a wide-open approach to the socioeconomic effects that the intervention of the union and labor inspection have on labor relations, a specific typology is proposed to understand and value these intersections.

The authors present a logical-legal analysis of the main arguments contained in the allegations that have been exposed in Peru in favor of implementing the reform of the employment security regulation downwards. Thus, since the period from the publication of the known judgments of the Constitutional Court on reinstatement, until the current debate raised after the unilateral approval of the National Productivity and Competitiveness Policy, the essay identifies the implicit and explicit arguments of those who propose a review of the regime of protection against dismissal. All this with the purpose of analyzing the constitutional basis of such argumentation from the tension that exists between the principles of freedom of Enterprise and employment stability.

Two mechanisms, covered by legality and widely used in conflicts of economic origin between employers and labor unions (such as arbitration and strikes), have a complex relationship. Here we propose a review of essential and incidental elements that configure both mechanisms for their legal-economic utility in union conflicts. To meet this purpose, we propose a review of relevant aspects of the pragmatics of strike and arbitration, comparing their similarities and differences, to recognize in them the institutions whose existence in economic conflicts surpasses any design or interpretation that intends to constrain it as a simple static or sequential resource.

Dos mecanismos, revestidos de juridicidad y de extendido uso en los conflictos de origen económico surgidos entre empleadores y sindicatos (como el arbitraje y la huelga), guardan una compleja relación. Aquí proponemos una revisión de elementos esenciales e incidentales que configuran a ambos mecanismos por su utilidad jurídico-económica en los conflictos sindicales. Para cumplir ese propósito proponemos una revisión de aspectos saltantes de la pragmática de la huelga y la del arbitraje, comparando sus semejanzas y diferencias, para así reconocer en ellas a instituciones cuya existencia en los conflictos económicos supera a cualquier diseño o interpretación que pretendan constreñirla a un mero recurso estático o secuencial.
