This situation implies that the promisor assumes the risk that the third party will or will not perform such an act before the promissory. Along these lines, the author maintains that the promise of the act of a third party constitutes an autonomous guarantee contract, where the promise of the promisor is configured as a guarantee. To this extent, this type of contract entails an obligation of compensation of the promisor to the promissory, not to be confused with compensation for damages, since in this case there is no breach of an obligation. In this way, this study represents a significant contribution since it delimits the scope of the contract under analysis, providing answers to various questions on the subject.La promesa del hecho de un tercero es un contrato mediante el cual una persona (promitente), se compromete frente a otra (promisario), a que un tercero ejecutará un hecho. Esta situación implica que el promitente asuma el riesgo de que el tercero realizará o no tal hecho ante el promisario. En esa línea, el autor sostiene que la promesa del hecho de un tercero constituye propiamente un contrato autónomo de garantía, en donde la promesa del promitente se configura como una garantía. En esa medida, ese tipo de contrato acarrea una obligación de indemnización del promitente frente al promisario, no debiendo confundirlo con el resarcimiento por daños, dado que en este supuesto no existe el incumplimiento de una obligación. De esta manera, el presente estudio representa una contribución significativa toda vez que delimita los alcances del contrato bajo análisis, proporcionando respuestas a diversas interrogantes sobre el tema.
