The promise of the act of a third party is a contract by which a person (promisor) undertakes before another (promissory), that a third party will perform an act. This situation implies that the promisor assumes the risk that the third party will or will not perform such an act before the promissory. Along these lines, the author maintains that the promise of the act of a third party constitutes an autonomous guarantee contract, where the promise of the promisor is configured as a guarantee. To this extent, this type of contract entails an obligation of compensation of the promisor to the promissory, not to be confused with compensation for damages, since in this case there is no breach of an obligation. In this way, this study represents a significant contribution since it delimits the scope of the contract under analysis, providing answers to various questions on the subject.
