Likewise, it is emphasized that, historically, civil law has been a key driver and component of modernization, providing order and predictability. However, the author points out that current civil law is facing a crisis, as it is perceived as less dynamic and as lagging behind in the face of socioeconomic changes. In this sense, it is criticized for its inertia in the face of rapid social change and its formalism, in addition to the migration of subjects to Public or Social Law. Finally, the author argues that this branch of law has opted for internal transformations, which are manifested mainly through the transition from modernity to postmodernity, ceasing to be an individualistic ethics to adopt a social and systemic perspective of justice.El texto explora la relación entre Derecho y tiempo, señalando cómo el Derecho intenta fijar un orden estático frente al dinamismo temporal, mientras el tiempo transforma internamente al Derecho. Con base en ello, se realiza una distinción entre modernización (proceso de cambio), modernidad (forma social concreta de los últimos tres siglos occidentales) y modernismo (adopción superficial). De igual manera, se subraya que, históricamente, el Derecho Civil ha sido un impulsor y componente clave de la modernización, aportando orden y predictibilidad. No obstante, el autor señala que el Derecho Civil actual enfrenta una crisis, ya que es percibido como menos dinámico y como un rezago frente a los cambios socioeconómicos. En ese sentido, se critica su inercia ante el cambio social rápido y su formalismo, además de la emigración de materias a Derecho Público o Social.
