Thus, Poulantzas analyzes the importance of phenomenology and from it seeks to discover the relationship between fact and value, finding in existentialism the essential requirements to counteract the problems brought about by phenomenology and, in this way, reconcile fact and value.  From this premise, value and fact are conceived as two moments of the human act that must be understood in a normative sociological context. At another point, Poulantzas will also address the link between freedom and necessity, as well as the function of law within society. Finally, for the author, Poulantzas does a meritorious work that seeks to analyze law from a perspective devoid of the juridical positivism that many jurists currently profess.El autor parte del planteamiento plasmado por el filósofo jurista Nicos Poulantzas, quien propone conciliar la filosofía del derecho con una visión existencial-marxista. Así, Poulantzas analiza la importancia de la fenomenología y a partir de ella buscará descubrir las relaciones entre hecho y valor, encontrando en el existencialismo los requisitos esenciales para contrarrestar los problemas que trae consigo la fenomenología y, de este modo, reconciliar el hecho y el valor.  Desde esa premisa, el valor y el hecho son concebidos como dos momentos del acto humano que deberán ser entendidos en un contexto sociológico normativo. En otro momento, Poulantzas también abordará la vinculación entre libertad y necesidad, así como la función del derecho dentro la sociedad.
