The purpose of this paper is to expose the misconception entailing the execution of attributes of the executive branch, as well as, the incautious legal measures that have had negative results in this sector.El presente trabajo busca dar cuenta de algunas cuestiones de actualidad sobre la manera en la que la Administración pública viene desplegando su facultad sancionadora en el marco de la ejecución de los contratos públicos.El análisis busca demostrar como se vienen cometiendo excesos en el ejercicio de esta facultad, causando mayores perjuicios a la contratación pública y no logrando la meta de luchar adecuadamente contra las conductas inmorales y la corrupción.
