Sumario:This paper intends to explore the political dimension of the reform of the Judicial Power and will concentrate on explaining the administration of justice in Peru, specifying its defects and needs in the political aspect and proposing an institutional scheme for the government of the Judicial Power that manages to rescue the political dimension that has been forgotten. The first part provides a brief introduction and develops the administration of justice in Peru, emphasizing its shortcomings and needs within the framework of Peruvian reality. The second part highlights the importance of the political aspect of the Judiciary and its lack of validity within the current Peruvian Judicial Branch. After that, the historical roots of the political nature of the administration of justice in the past are developed and how it should be applicable in the present. The fourth part points out the importance of Montesquieu in the design of the modern Judicial Power and the main characteristics that it contributed to it. Subsequently, it describes the way in which the functions of a judicial power could be designed that take into account its political and technical-legal function at the same time. Finally, an institutional scheme is proposed for the operation of the Judicial Power that encompasses the Supreme Court of the Republic, the Government Council and the President of the Judicial Power in order to achieve an adequate functioning.
