Within this framework, the IMO has completed an exploratory study, in which it adopted a preliminary definition of autonomous ships and identified three high-priority themes: the meaning of the terms master, crew, or responsible person; the consideration of the remote-control station or centre; and the possibility to designate remote operators as seafarers. Subsequently, the IMO established in 2022 a workplan to adopt a goal-based non-mandatory MASS Code in 2024 and a mandatory Code in 2025.Following the exploratory study and the workplan, the negotiations for the regulation of MASS at the IMO began in 2022. This ongoing work is considering how to adapt the existing regulation to allow States to operate MASS in compliance with the obligations and rights provided in UNCLOS and the IMO instruments, ensuring maritime safety.La regulación de los buques autónomos marítimos de superficie (MASS) hará necesario redefinir algunas categorías jurídicas y conceptuales tradicionales del derecho del mar, cuyas normas fueron adoptadas sobre la base de que las naves contaban con un capitán y una tripulación a bordo.Una interpretación evolutiva de la Convemar permite sustentar que la OMI asuma los trabajos para regular la operación de los MASS. En ese marco, la OMI ha completado un estudio exploratorio en el que adoptó una definición preliminar de los MASS e identificó tres asuntos que deben ser abordados prioritariamente: el significado de los términos capitán, tripulación o persona responsable; el tratamiento del centro o puesto de control a distancia; y la posibilidad de designar a los operadores remotos como gente de mar. La OMI también estableció una hoja de ruta para la adopción de un código sobre los MASS no obligatorio basado en objetivos para 2024 y de un código obligatorio para 2025.En seguimiento al estudio exploratorio y a la hoja de ruta, en 2022 se iniciaron las negociaciones para la regulación de los MASS en la OMI.
