Its application in special procedures is contemplated considering the sufficiency of the evidentiary activity required to distort the effects of the presumption in favor of the administered.El presente artículo explica y analiza los alcances de la presunción de licitud en el marco del ejercicio de la potestad sancionadora de la Administración Pública, desde su vinculación y sustento con la presunción de inocencia, así como sus efectos en el desarrollo de los procedimientos administrativos sancionadores, con especial incidencia en la carga de la probanza de los hechos y la participación del presunto infractor en los mismos.
