For this reason, in most cases, the sanction or punishment of the guilty party was based on the expiation of the crime that sought to recover the social equilibrium. To that extent, the objective of this article is to analyze the way in which the Incas understood and punished crime. For this reason, the author analyzes the different types of crimes, classifying them into four groups: (i) crimes against the state, the cult and the Inca, (ii) crimes against the person, (iii) crimes affecting property and (iv) sexual crimes. The author also points out that the Inca legal conception cannot be compared, nor measured, with the European conception since both are completely different and, therefore, evaluate crime differently.A diferencia de los modernos ordenamientos jurídicos que se han asentado a lo largo de la historia, los incas concebían como delito no a la transgresión de una norma legal propiamente dicha, sino a la alteración de un orden sagrado que se encontraba representado por los dioses y el Inca. Debido a ello, en la mayoría de los supuestos, la sanción o el castigo del culpable se basaba en la expiación del delito que buscaba recuperar el equilibrio social. En esa medida, el objetivo de este artículo es analizar la manera en la que los incas comprendían y castigaban el delito. Por esta razón, el autor analiza los distintos tipos de delitos, clasificándolos en cuatro grupos: (i) delitos contra el estado, el culto y el Inca, (ii) delitos contra la persona, (iii) delitos que afectan a los bienes y (iv) los delitos sexuales.
