To this end, we intend to demonstrate that, currently. the purpose of judicial precautionary protection is not to guarantee the effectiveness of the public power of the State, but to guarantee and make effective the subjective rights and their effect in the jurisdictional sphere.El análisis consiste en determinar si la tutela cautelar busca garantizar la eficacia de la soberanía del poder del Estado en el ámbito de la función jurisdiccional, para demostrar el poder absoluto que tiene y hacer prevalecer el mismo para dar una justicia efectiva o, si nos encontramos en la posición de un sentido jurídico distinto, que señala que la tutela cautelar garantiza la eficacia de los derechos subjetivos de las personas en un Estado de derecho constitucional. El fin supremo de este último es la defensa de la persona, que tiene derechos privados reconocidos dentro de un orden constitucional y jurídico.
