El presente estudio tuvo como objetivo principal determinar la relación que existe entre los factores jurídicos procesales asociados a la nulidad de las sentencias civiles. El estudio se desarrolló en las Salas Superiores del Distrito Judicial de Huánuco, en el periodo 2017; la muestra de estudio fueron 100 sentencias que fueron declaradas nulas por las Salas Superiores Civiles. El nivel y diseño de investigación es explicativo correlacional, de tipo prospectivo, analítico, transversal y observacional. La técnica utilizada fue la Documentación y el Instrumento; la Ficha de Recolección de datos. El instrumento fue validado por 05 expertos en el tema. At present there are serious questions about the efficiency of the criminal clause as a compulsory mechanism for compliance and conventional settlement of damages. Due to the fact that the penal clause does not offer any security to the contracting parties, they prefer to use other mechanisms that ensure the fulfillment of their obligations effectively, although they could represent higher costs. In this paper, we examine the functions of the penal clause, as well as its possible reduction and increase.
