The traditional study of real rights has been shaped by a unidirectional conception derived from dominium, focused on the subject-holder and object relationship. This approach, rooted in 19th-century categories, has hindered the analysis of complex contemporary legal realities. To address this shortcoming, an organic-global methodological approach is proposed—one that analyzes real rights based on the complex legal relationship, integrating its structural elements (subjective, objective, and causal). This proposal arises from the critical analysis of law school curricula from leading faculties in Spain and Mexico, where the persistence of static theoretical models was identified. Its goal is to reform legal education through a critical and organic mindset that goes beyond merely describing entitlements and instead examines interactions between ownership, propter rem duties, and erga omnes guarantees. It also seeks to foster the development of professional competencies that provide tools for resolving complex property-related situations. |

Este enfoque, anclado en categorías decimonónicas, ha obstaculizado el análisis de realidades jurídicas contemporáneas complejas. Ante esta insuficiencia, se propone un enfoque metodológico orgánico-global que analice los derechos reales desde la relación jurídica compleja, integrando sus elementos estructurales (subjetivo, objetivos y causales). La propuesta surge del análisis crítico de planes de estudio de facultades de Derecho líderes en España y México, donde se identificó la persistencia de modelos teóricos estáticos. Su objetivo es reformular la enseñanza jurídica mediante un pensamiento crítico y orgánico que permita superar la mera descripción de facultades para examinar interacciones entre titularidad, deberes propter rem y garantías erga omnes, así como favorecer la adquisición de competencias profesionales que brindan herramientas para resolver situaciones patrimoniales complejas.O estudo tradicional dos direitos reais tem sido marcado por uma concepção unidirecional derivada do dominium, centrada na relação sujeito-titular e coisa. Esse enfoque, ancorado em categorias do século XIX, tem dificultado a análise de realidades jurídicas contemporâneas complexas. Diante dessa insuficiência, propõe-se um enfoque metodológico orgânico-global que analise os direitos reais a partir da relação jurídica complexa, integrando seus elementos estruturais (subjetivo, objetivos e causais). A proposta surge da análise crítica de planos de estudo de faculdades de Direito líderes na Espanha e no México, onde se identificou a persistência de modelos teóricos estáticos.
