Descripción
Sumario:The concept of vulnerability is an open one that goes beyond the legal categories of capacity and incapacity. It requires a multidisciplinary analysis because it raises the humanization of the application of fundamental human rights and a resignification of legal operators. The intersectionality of discrimination can aggravate vulnerability, causing some vulnerabilities to attract others, which add up as layers of oppression and exclusion. Therefore, vulnerable groups require the drafting of effective tools to guarantee the full enjoyment of their rights under conditions of equality. Children and adolescents are vulnerable groups that require special protection measures. To this end, States should adopt positive action measures that guarantee effective judicial protection for children and adolescents. This paper presents a guide of good practices for the effective judicial protection of this vulnerable group.
