The problem is that a lot of ink has been spilled by lawyers and judges without distinguishing that when it comes to human rights such as decent housing, there are two types of foundations: visible foundations and invisible foundations. The first has to do with the international and national regulatory framework; while the latter have to do with the moral weight that said regulatory framework has. In the present work, the visible foundations are preeminently exposed, and a preliminary outline of the invisible foundations is left.El mejor criterio para entender la importancia del derecho a la vivienda adecuada o vivienda digna es el de sus fundamentos jurídicos. El problema es que mucha tinta ha corrido por parte de abogados y jueces, sin distinguir que, en cuanto a derechos humanos, como el de la vivienda digna, caben dos tipos de fundamentos: fundamentos visibles y fundamentos invisibles. Los primeros tienen que ver con el marco normativo internacional y nacional, mientras que los segundos tienen que ver con el peso moral que tiene dicho marco normativo. En el presente trabajo se exponen los fundamentos visibles de manera preeminente y se deja un esbozo preliminar de los fundamentos invisibles.O melhor critério para compreender a importância do direito à habitação adequada ou à habitação digna são os seus fundamentos jurídicos. O problema é que muita tinta tem sido derramada por advogados e juízes sem distinguir que quando se trata de direitos humanos, como uma habitação digna, existem dois tipos de fundações: fundações visíveis e fundações invisíveis. A primeira tem a ver com o quadro regulamentar internacional e nacional; enquanto estes últimos têm a ver com o peso moral que o referido quadro regulamentar tem.
