description This study discusses the challenges faced by the Peruvian judiciary when the pending controversies are related to Collective Law institutes. Although there are multiple edges and obstacles that surround collective labor relations, the purpose of this article is to expose the problems circumscribed to the beneficiaries of collective bargaining agreements resulting from minority unions, as well as the granting of conventional benefits to former service providers and CAS workers with a judicially recognized and subsequent relationship. In order to deepen in the analysis of such a robust subject, the author starts by breaking down historical, theoretical and normative aspects, referring to legal institutions of collective law and their significant presence in labor relations; in addition, she includes dissimilar pronouncements of the Peruvian Supreme Court of Justice, in order to know its position on the scope and extension of collective bargaining agreements. By means of the referred methodology, it concludes that extending the scope of action of benefits of a conventional nature (derived from negotiations of minority unions), to those who do not have the status of members, places the permanence of the union organization in a risky position.

Si bien son múltiples las aristas y óbices que rodean las relaciones colectivas de trabajo, el propósito de este artículo, reside en exponer la problemática circunscrita a los beneficiarios de los convenios colectivos resultantes de sindicatos minoritarios, así como el otorgamiento de beneficios convencionales a ex locadores de servicios y trabajadores CAS con vínculo reconocido judicialmente y con posterioridad. Para ahondar en el análisis de tan robusta temática, la autora parte desglosando aspectos históricos, teóricos y normativos, referentes a instituciones jurídicas de derecho colectivo y su significativa presencia en las relaciones laborales; aunado a ello, incluye pronunciamientos disímiles de la Corte Suprema de Justicia del Perú, a fin de conocer su postura sobre los alcances y extensión de los convenios colectivos. Por medio de la referida metodología, concluye que, extender el radio de acción de los beneficios de naturaleza convencional (derivados de negociaciones de sindicatos minoritarios), para quienes no ostentan la calidad de afiliados, sitúa en una posición de riesgo la permanencia en el tiempo de la organización sindical.O presente estudo discute os desafios enfrentados pelo Poder Judiciário peruano quando as controvérsias pendentes a serem elucidadas dizem respeito a institutos de direito coletivo. Embora sejam múltiplas as arestas e obstáculos que circundam as relações coletivas de trabalho, o objetivo deste artigo é expor os problemas circunscritos aos beneficiários de acordos coletivos decorrentes de sindicatos minoritários, bem como a concessão de benefícios convencionais aos ex-prestadores de serviços e trabalhadores do CAS com vínculo judicialmente reconhecido e posterior. Para aprofundar a análise de um tema tão robusto, a autora começa por decompor os aspectos históricos, teóricos e normativos, referindo-se aos institutos jurídicos do direito coletivo e à sua presença significativa nas relações laborais; além disso, inclui pronunciamentos díspares do Supremo Tribunal de Justiça do Peru, a fim de conhecer a sua posição sobre o alcance e a extensão das convenções colectivas de trabalho.
