spelling The evolution of the LGBTI community and its impact on the legal structure of the Ecuadorian stateLa evolución de la comunidad LGBTI y su incidencia en la estructura jurídica del estado ecuatorianoMiranda Polo , Gabriela Patricia Herrera Acosta , Carlos Ernesto ordenamiento jurídicoorientación sexualdiscriminaciónhomosexualismolegal systemsexual orientationdiscriminationhomosexualityThroughout history in the international and national context, new human groups and collectives have been developing that demand the recognition of their rights in the state legal system; One of these groups is the LGTBI community (Gay, Bisexual, Trans and Intersex), whose sexual orientation is one of the fundamental characteristics that makes them different from other members of a society and the reason that has caused discrimination, exclusion and Aggression In this context, most of the Constitutions of the Member States of the United Nations have embodied the right to equality and non-discrimination, which implies the recognition that we are all equal and no one can be discriminated against based on ethnicity, race, religion or belonging to an exclusive group; In this perspective, the manuscript carries out a historical, legal and critical analysis of the evolution of the LGBTI community, to determine how its struggle has affected the legal structure of the Ecuadorian State; the results of the investigation indicate that this group is one of the most vulnerable and that the public policies implemented by the State do not guarantee the principle of equality and non-discrimination of this group; In this sense, it is concluded by pointing out that in Ecuadorian society cultural stereotypes and social prejudices persist that cause the violation of the constitutional and human rights of the LGTBI collective.A través de la historia en el contexto internacional y nacional, se han ido desarrollando nuevos grupos y colectivos humanos que exigen el reconocimiento de sus derechos en el ordenamiento jurídico estatal; uno de estos grupos, es la comunidad LGTBI (Gay, Bisexual, Trans e Intersex), cuya orientación sexual, es una de las características fundamentales que les hace diferentes a los demás miembros de una sociedad y el motivo que ha provocado discriminación, exclusión y agresión.
