The findings show that for 9.4% and 17.2% of the interviewees, the principle of non bis in idem is applied very poorly and poorly respectively, 60.4% is regular and 13% is efficient. It is evident that there is a strong relationship between the sanctioning power of the CGR and the administrative disciplinary procedure with a value of Chi - Pearson Square 0.000 < α = 0.05, i.e., both fulfill their purpose. However, the problem lies when a public servant is prosecuted under both regimes, generating controversy with the principles of due process and non bis in idem.Se analiza la relación entre la potestad sancionadora de la Contraloría General de la República (CGR) y el procedimiento administrativo disciplinario en el marco de la Ley del Servicio Civil. La investigación siguió una metodología cuantitativa, transversal, con un diseño descriptivo y nivel correlacional. Los hallazgos muestran que para el 9.4% y el 17.2% de los entrevistados, el principio de non bis in ídem se aplica de forma muy deficiente y deficiente respectivamente, 60.4% es regular y 13% es eficiente. Se evidencia que existe una fuerte relación entre la potestad sancionadora de la CGR y el procedimiento administrativo disciplinario con un valor de Chi–Cuadrado de Pearson 0.000<α=0.05, es decir, ambas cumplen con su propósito.
