While it is recognized that the right to work break does not have a direct constitutional reference, it is worth noting that it comes from the sum of the fundamental rights to dignity and health. In accordance with what is argued, this analysis specifies the need for the right to work break to be valued more broadly, and we should focus on developing the bases by which it should be considered as a working condition in the preliminary project of the Labor Code.El autor del presente ensayo analiza el derecho al refrigerio en función del planteamiento efectuado a través del anteproyecto de Código de Trabajo planteado por el Ejecutivo y se detiene en desarrollar los alcances del derecho al descanso como género frente al refrigerio, ya que no solo debe abocarse a consumir los alimentos, con especial aunque no única referencia al almuerzo, sino también a desarrollar un espacio de interacción personal que permita al trabajador seguir su actividad de labores pasado el tiempo que el legislador le otorga para el consumo de alimentos. En este aspecto, si bien se reconoce que el derecho al descanso no tiene un referente constitucional directo, cabe dejar establecido que emana de la suma de los derechos fundamentales a la dignidad y a la salud.
