description Informality is conceived as a social phenomenon and legally reprehensible, as it does not align with the standards of good coexistence within the community, and is perceived, from this perspective, as contrary to the rationality of the Western world. However, beyond these considerations, which are not always acceptable and involve more of a value judgment than an objective reality, this phenomenon is a response to the various contexts citizens face. Among these, it stands out as a means of adaptation to state rules. Typically, the concept of informality is linked to the private sector. However, against all expectations, informality is also present in the public sphere, particularly in the area of personnel provision within public-law organizations. In this context, the author focuses on analyzing the various concrete expressions that, within the Peruvian context, allow for the identification of informality. This is based on the idea that legal relationships concerning personnel are a key space where the state exploits service provisions for its own benefit using various legally reprehensible mechanisms, with the aim of disregarding the reality of proper administrative self-organization. The author concludes that the Peruvian state is a space where both formal and informal rules coexist, and significant governmental efforts are identified to self-limit such anomalous institutional practices.

Ahora bien, normalmente se vincula la figura de la informalidad al sector privado. No obstante, contra todo pronóstico, la informalidad también tiene presencia en el ámbito público con especial incidencia en el espacio de la provisión de personal al interior de las organizaciones jurídico-públicas. Teniendo en cuenta este contexto, el autor se enfoca en analizar las diversas expresiones concretas que, en el ámbito peruano, permiten la identificación de la informalidad considerando que las relaciones jurídicas de personal son el espacio propicio para que el Estado aproveche las prestaciones de servicios en beneficio propio utilizando diversos mecanismos, reprobables jurídicamente, con los cuales pretende desconocer la realidad de una adecuada autoorganización administrativa. Procede a concluir que el Estado peruano es un espacio de convivencia de reglas formales e informales y llegan a identificarse importantes esfuerzos gubernamentales para autolimitar tales prácticas institucionales anómalas.A informalidade é concebida como um fenômeno social e juridicamente reprovável por não se adequar aos padrões de boa convivência na comunidade, sendo valorizada, a partir dessa percepção, como contrária à racionalidade do mundo ocidental; no entanto, além dessas considerações nem sempre aceitáveis que implicam mais um juízo de valor do que uma realidade objetiva, essa figura é uma resposta a vários contextos enfrentados pelos cidadãos, inclusive pelo fato de constituir um meio de adaptação às regras do Estado. No entanto, a informalidade geralmente está ligada ao setor privado. Não obstante, contra todas as probabilidades, a informalidade também está presente na esfera pública, com uma incidência particular na área de fornecimento de pessoal em organizações públicas legais. Levando em conta esse contexto, o autor se concentra em analisar as diferentes expressões concretas que, no contexto peruano, permitem identificar a informalidade, considerando que as relações jurídicas de pessoal são um espaço propício para que o Estado se aproveite da prestação de serviços em seu próprio benefício, utilizando diferentes mecanismos, juridicamente condenáveis, com os quais pretende ignorar a realidade de uma adequada auto-organização administrativa.
