El presente informe jurídico analiza la sentencia del 19 de abril de 2004 de la Sala de Apelaciones del Tribunal Penal Internacional para la ex Yugoslavia (TPIY) que condenó a Radislav Krstic por genocidio, crímenes de guerra y crímenes de lesa humanidad por su participación en los crímenes cometidos en Srebrenica en 1995, en el contexto de la Guerra de Bosnia. El problema principal del caso consiste en la modificación de la Sala de Apelaciones en la modalidad de atribución de responsabilidad para condenar a Krstic genocidio. Mientras la Sala de Juicio lo consideró como coautor mediante una empresa criminal conjunta, la Sala de Apelaciones consideró que la modalidad que mejor se ajustaba a sus actos era la de ayudante y alentador al genocidio. El informe analizará los motivos de esta decisión, analizando los fundamentos de la Sala de Apelaciones para cambiar la modalidad de atribución de responsabilidad, basándose principalmente en que Krstic no compartía la intención genocida. Para profundizar en ello, se analizará la intencionalidad específica requerida en el delito de genocidio a partir de doctrina y jurisprudencia. También se analizará en profundidad las modalidades de atribución de responsabilidad para este delito, con el fin de determinar si la modificación de la Sala de Apelaciones fue adecuada. Finalmente, el autor sostendrá que el cambio de modalidad de atribución de responsabilidad no fue adecuado y que la modalidad de coautor a través de la empresa criminal conjunta era la más adecuada para Krstic. |

Finalmente, el autor sostendrá que el cambio de modalidad de atribución de responsabilidad no fue adecuado y que la modalidad de coautor a través de la empresa criminal conjunta era la más adecuada para Krstic.This legal report analyzes the decision of April 19, 2004 of the Appeals Chamber of the International Criminal Tribunal for the former Yugoslavia (ICTY) that convicted Radislav Krstic of genocide, war crimes and crimes against humanity for his participation in the crimes committed in Srebrenica in 1995, in the context of the Bosnian War. The main problem of the case is the modification of the Appeals Chamber of the ICTY regarding the mode of liability for convicting Krstic for genocide. While the Trial Chamber established that Krstic was a co-perpatrator for his participation in a joint criminal enterprise, the Appeals Chamber considered that he was an aidor and abettor to genocide, as he did not shared the genocidel intent with the main authors. The report will analyze the reasons for this decision, disclousuring the arguments of each instance for attributing each mode of liability for genocide, based mainly on whether or not Krstic shared the genocidal intent. To delve deeper into this issue, the specific intent for the crime of genocide will be analyzed using doctrine and case law. Modes of liability for attributing this crime will be analyzed in deep too, with the porpuse of determining if the modification of the Appeals Chamber was justified.
