Como segundo punto, se presenta un análisis funcional de la congruencia; en particular, se destaca su importancia para definir el alcance del litigio y el marco sobre el cual las partes ejercerán su defensa. Finalmente, el informe evalúa si existió o no alguna vulneración del principio de congruencia y del derecho a la defensa en el laudo arbitral cuya validez fue confirmada en sede judicial.
