El presente trabajo académico se propone analizar cómo la Sala Especializada de Protección al Consumidor a abordado el derecho que tienen los consumidores a ingerir alimentos libres de causar daños a la salud (deber de inocuidad), y el deber de los proveedores de ofrecer alimentos inocuos en el mercado. Para tal efecto, se recurrirá a un marco normativo como son el Código de Protección y Defensa del Consumidor, la Ley y Reglamento de Inocuidad de los Alimentos, así como a Resoluciones Administrativas emitidas por el Indecopi; y, a recientes fuentes doctrinarias. Todo ello con la finalidad de demostrar la importancia de la protección de brindar alimentos inocuos/seguros a los consumidores. Asimismo, exponer el rol de las autoridades competentes en la presente materia; y, exhibir que se configura como falta grave o muy grave la reincidencia en la falta del deber de inocuidad por parte los fabricantes.

However, what happens when this duty is infringed by suppliers, and they offer products in the market that put the health of consumers at risk. This academic paper we propose to analyze how the Specialized Chamber of Consumer Protection has addressed the right of consumers to eat food free from causing harm to health (obligation of innocuousness), and the obligation of suppliers to offer safe food on the market. For this purpose, we will resort to a normative framework such as the Consumer Protection and Defense Code, the Food Innocuousness Law and Regulations, as well as Administrative Resolutions issued by Indecopi; and recent doctrinal sources. All this with the purpose of demonstrating the importance of the protection of providing safe food to consumers.
