En el presente caso, el señor Carlos Calle Mendoza presentó una denuncia contra el Banco BBVA PERÚ S.A. por presuntamente haber incumplido con activar los protocolos de seguridad al momento que se efectuaron nueve (09) operaciones no reconocidas de consumo realizadas con su tarjeta de débito. En ese sentido, el presente Informe pretende responder al problema principal que es identificar si el Banco fue responsable de vulnerar el deber de idoneidad señalados en el artículo 18 y 19 del Código, por no haber aplicado sus protocolos de seguridad al momento que se efectuaron las operaciones. Para este propósito, se emplearán los métodos literal y sistemático por ubicación de la norma, los cuales incluirán la revisión de la normativa, doctrina y jurisprudencia relacionadas con el tema en cuestión. De esta manera, mediante un análisis integral de todos estos elementos, se podrá llegar a la conclusión de que el Banco sí vulneró el deber de idoneidad respecto de siete (07) de las nueve (09) operaciones efectuadas.

In the present case, Mr. Carlos Calle Mendoza filed a complaint against Banco BBVA PERÚ S.A. for allegedly failing to activate the security protocols when nine (09) unrecognized consumer transactions were made with his debit card. In this sense, this Report intends to respond to the main problem as to whether the Bank was responsible with respect to the duty of suitability indicated in articles 18 and 19 of the Code, for not having applied its security protocols at the time the operations were carried out. For this purpose, the literal and systematic methods by location of the norm will be used, which will include the review of the regulations, doctrine and jurisprudence related to the subject in question.
