Sobre el particular, la Casación N° 1353- 2019-UCAYALI y su expediente permitieron evidenciar dos posiciones contrarias sobre la gestión forestal entre el SERFOR y el OSINFOR, así como, la configuración de la guía de transporte forestal como parte del elemento normativo “otros documentos de gestión forestal” del delito de Responsabilidad por Información Falsa contenida en Informes (artículo 314-B del Código Penal). En esa línea, el informe se sustenta en tres capítulos que permiten el desarrollo dogmático del bien jurídico ambiental y de los delitos ambientales, así como la aplicación de la técnica de la Ley Penal en Blanco. Del mismo modo, se analiza la regulación administrativa forestal en el momento del acontecimiento de los hechos ocurridos (2013), así como la regulación actual en el marco de la trazabilidad de la madera en el Perú. Este trabajo permite tener una investigación de fuentes bibliográficas nacionales e internacionales, así como de entrevistas a seis expertos nacionales en materia forestal y penal. De esta manera, el trabajo busca identificar cuáles son las razones jurídicas para configurar los alcances del delito del artículo 314-B del Código Penal, en el marco de trazabilidad de la madera. Finalmente, se propone algunas recomendaciones para la mejora del tratamiento de dicho tipo penal, así como asegurar una adecuada justicia ambiental ante delitos por responsabilidad funcional.

In this regard, Cassation N° 1353-2019-UCAYALI allowed to demonstrate two opposite positions on forestry management and mainly on the configuration of the forestry transportation guide as part of the regulatory element “other documents of forestry management” of the crime of Liability for False Information displayed in Reports (article 314- B of the Penal Code). In this context, the document goes through three different chapters, allowing the dogmatic development of the legal environmental asset, as well as the application of the blank criminal laws or laws in need of complement. In the same manner, the document analyzes the forestry administrative regulation at the time the events occurred (2013), as well as the current regulation in the framework of the wood traceability in Peru. In this respect, this document allows to have research of national and international bibliographic sources, additionally interviews to seven national experts on the different subjects covered in the three chapters. Consequently, seeks to identify which are the legal reasons to configure the scope of the offense in article 314-B of the Penal Code, in the framework of wood traceability.
