Bajo esa misma línea, las agencias de viajes minoristas tienen la función de la elaboración, comercialización, orientación, brindar asesoría e información de los servicios turísticos nacionales e internacionales que tiene a su disposición. Ahora bien, ¿qué ocurre cuando estas empresas omiten información a los consumidores? En el presente informe se analizará lo resuelto en la Resolución N° 435-2016/SCPINDECOPI por la Sala Especializada en Protección al Consumidor que revocó la resolución emitida por la Comisión de Protección al Consumidor N° 2 al considerar que la agencia de viajes no tenía la obligación de brindar información respecto de las penalidades por la reprogramación de los paquetes turísticos y de los pasajes aéreos. Por ello, se realizará un marco teórico en la cual se explicará los alcances del deber de información, la responsabilidad que tiene el proveedor y si la reprogramación y penalidades debería ser considerado información relevante

This report will analyze what was resolved in Resolution No. 435-2016/SCP-INDECOPI by the Specialized Chamber on Consumer Protection that revoked the resolution issued by the Consumer Protection Commission No. 2 by considering that the travel agency did not have the obligation to provide information regarding the penalties for the rescheduling of tour packages and airline tickets.
