En tal sentido, se efectuó un análisis de la evolución histórica de este tipo de daño y se le aplicó las pautas de investigación de la responsabilidad extracontractual regulada en Código Civil, es decir, la exposición al peligro. El resultado de la investigación conlleva a sostener que el daño potencial no existe, pues en realidad lo que allí se regula es daño, como cualquier otro, pero cuyo alcance es más limitado que, por ejemplo, el daño ecológico.
