En los accidentes de trabajo con muerte sobrevenida se debe explicar cómo se infiere la responsabilidad del empleador, si es que este siempre responderá o si podrá excluírsele de la formula. Asimismo, resulta importante analizar el rol que tiene el nexo causal en este análisis, término utilizado en la responsabilidad civil y que puede ser aplicado para entender la naturaleza o el tratamiento legal de la muerte de un trabajador que sobrevenga de un accidente de trabajo.
