El Tribunal Registral aprobó en el CIX Pleno Registral el Precedente de Observancia Obligatoria que admite la inscripción de la renuncia del derecho de propiedad sobre un predio y su consecuente desinmatriculación del Registro, siempre que no se vean afectados derechos de terceros. Al respecto, el Tribunal Registral ha omitido considerar que la admisión de esta posibilidad en nuestro ordenamiento trae consigo múltiples incongruencias con la normativa actualmente vigente, además de contravenciones a los derechos de otros. Mediante el presente Informe Jurídico, pretendemos brindar visibilidad a aquellas vertientes como la condición de numerus apertus del artículo 968° del Código Civil, la falta de titular, la afectación a terceros, el objeto jurídicamente posible y la función calificadora del Registrador, así como otras formas de saneamiento registral. Con lo expuesto, argumentaremos las razones por las cuales la inscripción de la renuncia del derecho de propiedad en nuestro ordenamiento jurídico no es viable y cómo es que resulta ser contingente. Con ello, buscamos realizar un aporte académico y fundamentado en la función social de la propiedad que, aunado al Estado democrático y constitucional que rige nuestro país, motive el examen sobre esta materia tan controversial en la academia y se sienten bases sólidas sobre el particular. |

Con ello, buscamos realizar un aporte académico y fundamentado en la función social de la propiedad que, aunado al Estado democrático y constitucional que rige nuestro país, motive el examen sobre esta materia tan controversial en la academia y se sienten bases sólidas sobre el particular.The Registral Tribunal approved in the CIX Plenary Session the Precedent of Mandatory Compliance that allows the registration of the renunciation of property rights over a property and its consequent removal from the Registry, provided that third-party rights are not affected. In this regard, the Registral Tribunal has overlooked that admitting this possibility in our legal system brings about multiple inconsistencies with the current legislation, as well as violations of others rights. Through this Legal Report, we aim to shed light on aspects such as the open numerus condition of article 968° of the Civil Code, lack of ownership, impact on third parties, legally possible object, the Registrar's qualifying function, and other forms of registry regularization. Based on these points, we will argue why the registration of renunciation of property rights in our legal system is not feasible and why it remains contingent. Our goal is to contribute academically and substantiate discussions on the social function of property, aligning with the democratic and constitutional state that governs our country.
