Se advierte que el Código Procesal Civil de 1993 ignora que existen diversos supuestos en los que el demandado es declarado rebelde por causas ajenas a su voluntad o que no le son imputables, lo que impide la efectividad del derecho de contradicción. Por este motivo, a partir de una crítica del Proyecto de Reforma del Código Procesal Civil de 2018 y del Proyecto del Nuevo Código Procesal Civil de 2021, en esta investigación se aborda la necesidad de una regulación normativa que contemple no sólo las causales de la rebeldía involuntaria, sino también un remedio procesal idóneo al que pueda recurrir el rebelde involuntario luego de que la sentencia expedida en un proceso seguido en su contra haya adquirido la calidad de cosa juzgada.
