description El presente informe jurídico desarrolla y analiza el conflicto acontecido entre una persona jurídica (Hacienda el Potrero S.A.C) con derecho otorgado para uso de agua para riego, frente a los operadores hidráulicos (Comisión de Usuarios “La Papaya”), los cuales comparten la misma infraestructura hidráulica, el canal de San Juan de Marañón. Al respecto, se emplea el método dogmático enfocado en analizar fuentes escritas en materia de leyes, regulaciones administrativas, sentencias, resoluciones administrativas y artículos académicos de análisis para poder determinar las potestades y limitaciones conferidas a dichos operadores, en contraste con el reconocimiento de los derechos conferidos por la Administración Nacional del Agua para el aprovechamiento del agua. A lo largo del informe, se presentan puntos relevantes de discusión que involucran el caso, como son los establecimientos de tarifas extraordinarias hacia la empresa usuaria del agua, las facultades que poseen las Juntas de Usuarios de Agua y las Comisiones correspondientes. Asimismo, la idoneidad de la determinación de responsabilidad para sancionar al presidente y los demás integrantes de la Comisión. Finalmente, se proponen reflexiones y recomendaciones sobre la naturaleza de los operadores y la atención en su regulación para evitar posteriores conflictos de naturaleza similar

In this regard, the powers and limitations conferred on these operators will be analyzed, in contrast to the recognition of the rights conferred by the National Water Administration for the use of water. Throughout the report, relevant points of discussion that involve the case are presented, such as the establishment of extraordinary rates for the company and the organization of the Water Users Boards and the corresponding Commissions. Likewise, the suitability of the determination of responsibility to sanction the members of the Commission is reviewed.
