La prueba de oficio es una institución procesal que ha sido duramente criticada por algunos y, a su vez, fervientemente defendida por otros. En ese sentido, el objetivo principal de la presente tesis es defender y sustentar la idea de que la prueba de oficio es incompatible, tanto con la lógica interna del proceso civil, así como con las exigencias constitucionales que existen sobre el juez. Así, primero, desarrollaremos las aproximaciones teóricas sobre el proceso judicial, y las principales posturas respecto a su finalidad. Luego, repasaremos brevemente lo que se conoce como la prueba de oficio como institución jurídica, explorando su evolución normativa en el Perú y sus principales características. Por último, realizaremos una crítica a la prueba de oficio, y, delinearemos unas cuantas alternativas a la prueba de oficio, las cuales han sido propuestas y defendidas en la doctrina nacional. |
